Total and Permanent Disability (TPD) claims in Perth

Your total and permanent disability insurance claim follows any injury or illness which stopped you from working in:

  • Your usual job

  • Any role that your suits your experience, training or education

What is total and permanent disability insurance?

Many superannuation funds include total and permanent disability insurance, or it can be a stand-alone policy. Total and permanent disability insurance exists to provide financial support (usually a lump sum payment) if you suffer any injury or illness that permanently prevents or disables you from returning to your job.

Each total and permanent disability insurance policy is different. Different policies define ‘what total and permanent disability is’ and the circumstances under which they will make a lump sum payment.

Depending on the terms of your policy, total and permanent disability insurance covers you for being unable to work in:

  • The job you had before your disabling injury or illness

  • Any job you’re suited to because of your experience, training, or education

Can I make a Total and Permanent Disability claim?

You can make a TPD insurance claim if your injury or illness means you’re permanently prevented from working in your usual job, or in any other role that you’re suited for (because of your experience, training or education).  The injury or illness doesn’t have to be work-related.

Your TPD claim can be due to, for example:

  • Cancer

  • A heart attack

  • Chronic illness

  • A physical injury sustained anywhere – at home, playing sport, on the road or at work

  • A mental illness, in certain circumstances

An experienced TPD claim lawyer can help ensure that you secure the maximum compensation you’re entitled for your total permanent disability claim.

Our TPD claim lawyers can also help you to navigate the process so you’re able to focus on the needs of your injury or illness. At Stephen Browne Personal Injury Lawyers, we’re committed to assisting you in achieving the best outcome for your total and permanent disability claim.

FAQs

How Do I Know If I Have Total and Permanent Disability Insurance?

In Australia, total and permanent disability insurance policies are available through:

  • Your superannuation fund

  • As a separate policy, or packaged with a life insurance policy

If you’re not sure of your cover or how to progress with your total and permanent disability claim, get in touch with us. We can arrange for an obligation-free first consultation to review your TPD claim and provide advice specific to your circumstances.

How much do lawyers charge for a TPD claim?

Each claim for total and permanent disability insurance is different. Our team at Stephen Browne Personal Injury Lawyers are passionate about ensuring everyone has access to the entitlements they deserve, regardless of their background or financial situation.

Our TPD claim lawyers offer No Win, No Fee* representation for total and permanent disability claims. Read more here about what that means for your situation or get in touch with our team to schedule an obligation-free consultation.

How long does a TPD claim take?

There isn’t a legal framework requiring total and permanent disability insurance companies to make decisions within a certain time.

On average, successful total and permanent disability insurance claims take between 6 to 12 months. Your circumstances, injury, illness and policy details are all relevant to how long a TPD claim can take. Our experienced TPD lawyers can help you navigate the total and permanent disability claims process.

What is Life Insurance?

Life insurance is different from TPD insurance and provides a lump sum payment to your nominated beneficiaries when you die. If your life insurance policy has ‘terminal illness cover’, the lump sum payment could be made if you’re diagnosed with a terminal illness with a reduced life expectancy.

If your life insurance policy doesn’t name any beneficiaries, your estate or policy trustee will decide who the lump sum is paid to.
